    Default Property Management Employee Eviction

    I am a property management employee. I was living on site at a property where I was the assistant manager. I made $15.00 plus a free apt. Well Not free it was part of my compensation package. If I did not live on site I would have made more money. I was given a rent comp in place of wages. I singed a lease agreement for MTM tenancy @ $0.00. As well as an employee agreement that said I would have to move with-in one week if employment ended ( lease said 30 days). My offer letter said my hr wage was $15.00 and that deductions for housing would be made bi-weekly. I never saw the deductions on my paystub but I know I would have made at least 10k more if i did not live in the apartment. When I was terminated I was given 2 weeks to move ( other white 'ee was given 30 days. I am black). I believe that was discrimination but was it illegal??? Was I there by license or tenancy?

    First off...I find it very offensive that you chose to use the word "white-ee". That was very uncalled for. How would you feel if people referred to you as a "dark-ee"?

    Secondly...since you signed an agreement that you would vacate the premises within 1 week of termination...and they are giving you 2 weeks, how can you call that discrimation? You don't know the circumstance of the other employees termination or agreement.

    Thirdly, since you were give a rental package in lieu of wages...then you are considered an employee...not a tenant.

    So the very first time you were paid - and you saw you were being shorted in your wages - what did you do?

    Sorry I did not mean to be insensitive. A Caucasian 'EE with the same agreement as me was terminated. The conversation happened within ear shot. He was offered 30 days to move I was only offered one week. when I asked for more time I was told I could have 2 weeks if I paid my utilities within 24 hrs. no such demands were made on the other 'ee. in fact he moved out with a balance due and no one cared! I am not comparing my self to another tenant but another 'ee that was treated differently than myself. This appears to me is a violation of fair housing law. Weather I was employee there or not they were still housing providers. As far as the contract to move in one week I was asking because in CA you are supposed to allow 30-60 days notice to end a tenancy. I was curious because I thought that A) the lease I signed that stated my: tenancy" as MTM may superseded that agreement
    B) The stipulation to vacate in one week was contrary to the law it may be invalid.
    The Department of Fair Housing has accepted my complaint and reps have stated that I will get damages out of pocket and emo. An investigation is under way...so there is no need to be condescending. My question was if the eviction was illegal for it being less than 30days. Thank you for your input.

    That the thing, the offer letter reads like I am paying rent via deductions. and that was my assumption in taking the job. I did not say anything when my pay stubs showed no deductions. I should have! If I know that would be the case I would have made my full compensation and just paid rent out of pocket.

    BTW- I would not be bothered if you called me a Black 'ee! That is what I am in this context of race ( although I am quite light ) That is what all of the race questionnaires say "black / African American". That’s just me though. I am truly sorry if I offended you or anyone else.

    I guess a follow up question would be if I can include the rent comp in my wages. on pay stub or not the market rent was 1130 and the statement I got every month stated a 'ee rent comp of $985.00 a month. I was told that 15.oo was as much as I could make with the apt. I may have misunderstood then but would like to be very clear on the actual compensation I was getting!
