    Question Domestic Violence

    My question involves criminal law for the state of: my boyfriend and i had a major fight this weekend, he slapped me accross the face and punched me leaving me with a black eye, in return i bit off some skin off his hand, tore all his clothes and broke his tv and radio. So he has opened a case againsnt me as well for assault, damage of property and threating messages. i opened a case against him for hitting me. How strong is my case to his....should i settle out of court or i stand a chance of winning it in court

    Once a police report was filed, the decision-making in the criminal case stopped being in your control. The state (in the form of the prosecution) will be the one deciding if the charges will be pursued against one of you, both of you, or neither of you.
