    Default Repossession of a Vehicle in Texas

    My question involves a consumer law issue in the State of: Texas. My mother took out a car loan in her name for a friend two years ago. This person is making late payments and not returning my mother's calls. To make matters worse she called the Lender requesting to have vechile repossed. They advised her they will only do it from her and not a given address. My mother is on senior income and unable to make car payments but to make matters worse she was told that the person that has the car is planning to leave the United States. This person is looking for a buyer to sell this vechile to,which is not paid off, to send across to Mexico. She has advised lender of this situation but they seem very uncooperative and not willing to assist in the repossesion. Please help.

    She should consider small claims court.

    Title is exclusively in the friend's name?

    I am in a similar situation. My mother is elderly and unable to make car payments. So we allowed this person who was referred to us to take over the payments on her vehicle. It has been a hassle from day one. Within a week or two of getting the vehicle he quit his job and his wife was fired. So they couldnt make the payment. I treatened to call the police & report it stolen since they werent paying on it. He then had someone call and harrass us saying they were a lawyer. He has now had the vehicle for over 6 months and is almost 3 months behind. He does not have insurance and won't return our calls. We just found out he moved without giving us a new address. The finance company is not helpful at all. They say they will repossess it from us only & we have to repo it from this other individual. Does anyone have any advice on what I should do. The police won't get involved because it is a civil matter. I really can't afford a lawyer, but I am beginning to believe that is my only options.
