    Default Unemployment Appeal

    My question involves unemployment benefits for the state of: Ohio
    I was fired from my position in the beginning of January and have received unemployment since then. I was granted unemployment, my employer appealed, and I continued to receive unemployment. They then appealed again and did not provide any further proof that I was terminated for just cause (they gave me a vague termination letter saying I broke a policy without saying which one). Again, I continued my unemployment since they provided no proof. Now they are appealing again and I have to go to court. Their proof that I was terminated for just cause continues to be unclear and I still do not know which policy I broke. I have spoken to a lawyer who has not been too helpful. My question is, if I lose this appeal how am I to pay back the over $8,000 in unemployment. I have not been able to find another job and I am just getting by as it is. How stringent are the laws about paying back unemployment? Thanks.

    In most states, you can apply for a temporary "waiver" of repayment until you get another job and can arrange a repayment plan. IF the decision is overturned and IF you don't have another level of appeal, the letter you will get should include either waiver information or a phone number to call where you can ask about it.

    I am currently in the same situation and in the midst of appealing the initial appeal. I missed my telephonic hearing while at a job fair with phone off. I understand that they would stop my benefits while only hearing one side of the story but even at that, they did not rule for me to have to pay back what I have already received and my former employers account is still charged the payments for not providing adequate requested information in the beginning. I am awaiting my appeal decision at this time. It really stinks that I was fired without cause, no termination paperwork and over the phone!! Now the former employer wants to "create" a misconduct situation. If there had been misconduct, it would certainly been stated when I filed my initial claim and it wasn't. You aren't doomed to repay. My state is Tennessee.
