    Default Restitution After Theft

My question involves criminal law for the state of: Wisconsin

I wasn't sure where to put this question so please forgive me . YES, I know this isn't shoplifting related!!

My daughter's Ipod was stolen out of her locker at school. The boy (14) was arrested with the item (along with several other students' items) in his possession and he was arrested. We were notified by the DA's office that we'll be receiving paperwork for the restitution. We will be submitting the receipt for the Ipod, but I'm wondering if we are able to sue for that plus the amount she paid for the songs she downloaded. I'm not talking about jacking up the amount of restitution just to stick it to him (his parents) but the songs are part of the "package". I'm just not sure if I'm able to do that.

    What are your thoughts?

I would be happy with just getting the money to replace the ipod.

your child should have a backup play list stored onto his CP, just plug the new ipod into the CP and the songs will install from itunes into his new device.

aren't the songs on your computer? I am not familiar with I-tunes but since you are purchasing a license, have you sought info from I-tunes about downloading the songs again?

If it is truly a loss, and you can support the claim, the worst they can say is no.

Why isn't she getting the item back?
