    Default Wrongfully Determination

    I worked for a car dealer and was accused of cutting a key for a car. There was a investagation going on about a car being stolen and the key was cut at the deler were I was employed. I was accused because someone had used my employee ID number to cut the key. Therefore I was terminated form the job and was told to sing seprtion forms and that I wasn't able to file for unemployment. But I asked the my managers that there has to be a time and date were this key was cut and they didn't give me any information. All they said was that there was an investagation going on about this key. My department manager is aware of people using others people Id number.

    If anyone can give me some advice were to start......

    Your termination was legal. Your former employer isn't legally required to tell you the date the key was cut. You may file for UI; whether or not you receive benefits is up to the UI commission, not your former employer.

    I forgot to mention I worked for the company for 3 1/2 years I've never had a problem with them never got written up or got any type of verbal warning.

    If your employer has already made the decision to fire you and/or has already done so, there is no benefit to you to sign anything unless they are offering you some form of compensation for doing so. You certainly should not sign any agreement that says you will not file for unemployment. Based on what you have posted, when you file for ui they will claim you were fired for making that key. Only you know if you actually did. If they file a criminal complaint against you or threaten to, see a criminal defense attorney. Getting charges pressed against you on this would require that they find enough evidence to convince a prosecuter to file charges.

    Honestly I wasn't me and the reason why they say is it was me because someone must of used my Id number to do it. They don't have any proof or evidence to proof to any one that I did it

    Doesn't matter. Employers are legally allowed to fire people who they suspect did something wrong. They don't require any proof whatsoever for the firing to be perfectly legal. Period.

    Just as an FYI, a wrongful termination does not mean you were fired for something you didn't do. It means you were fired for a reason prohibited by law.

    The employer does not get to prevent you from filing for unemployment. They are free to contest it, just as you are free to file. But there is no reason to sign something agreeing not to file for unemployment, and I doubt if it would be enforceable anyway.
