    Default Buying a Car from Private Seller, Found Out Car Has a Lien on It

    I have posted here, but I wanted to update and see if I could get any advice. I am purchasing a car from a private seller for the price of $1800. I paid 900, and after 4 weeks I was suppose to pay the other 900. A week before i had to pay I found out the car had a lien on it. The lien is 600, so I contacted the seller, they said they paid it. a day before I had to pay I called the lien holders and they said it was not paid. I then contacted the sellers, they said I could pay the 600 on the lien and then the 300 to them. I said ok. I called the lien holders and because they lien had not been paid it is not over 956. I agreed to pay it, but not yet. I emailed, txt and left a voice mail telling the sellers that the lien is now over what I agreed to pay, but that I would pay it, but I would owe nothing to them. It has been 3 days and they will not answer my call or get back to me. What do I do? the longer i wait the more the lien will cost. Thank you for any help. Hope it is understandable.

    what do you want to do?

    Obviously you have a right to rescind the sale if the seller cannot or will not provide you with a clear title. If you want to continue on with the sale, what you can do is basically what you are willing to do.

    Well now I want to rescind the sale because I found out that the lien goes up everyday now because they have not made a payment in almost 2 months, so it is now 840. And I was informed by the lien holders that within the next few days they are going to reposes the car. The sellers wont even answer the phone. If i do call the cops, what do I say? Thank you.

    the cops won't do anything for you. This is purely a civil matter. You need to make a demand on the seller and if he refuses to return your money, about the only thing you can do is sue the person and then you still need to collect your judgment.
