    Default If You're Convicted of a Crime But Live in Another State, Where is the Penalty Served

    State of Illinois law

    I have a completely clean record - no traffic violations, anything, ever - prior to this misdemeanor charge (total of $22)I placed something in my bag, out of the package and forgot about it - I know, likely story) what penalties can I expect? Realistically. I know that I can pay up to $1000 and spend a year in jail, but what can I actually expect? How much in fines?

    If I am convicted of a retail theft misdemeanor that I "committed" in Illinois, and I live in Florida and am sentenced to serve community service (which seems to be a popular penalty) will I be expected to serve the community service in Chicago?

    Budget for $1000, because no one here can tell you exactly how much you'll be assessed.

    Best case scenario, you qualify for a diversion program for first offenders and are able to get your probation and community service moved to your home jurisdiction.

    You'll need an attorney to accomplish this. If you cannot afford private counsel, plead Not Guilty at your arraignment and ask for a Public Defender.

    What exactly do I need a lawyer for?
    Also - the arraignment - does this mean that I'll have to go to court 2 times? I really only have enough money to make it there and stay there for a day or two -- literally. In this case should I just plead guilty?

    You need an attorney to make arrangements for a diversion program, if one is available to you. This will keep your court appearances to one (usually) AND a diversion program has the added benefit of keeping the charge off your record if you successfully complete the program.

    In this case should I just plead guilty?
    Only if you're totally in love with being branded a thief for the rest of your life.

    What exactly is meant by one? That I'll only have to go once? I understand that my court date is an arraignment, but would it be possible to maintain my innocence, and have a hearing the same day?

    If I am found guilty - will I be able to get the charge expunged?

    Sometimes yes, sometimes no. Depends on the court's scheduling.

    Maybe. It's a far more involved process than simply getting an attorney and shooting for a diversion program.

    Look, you need an attorney. Doesn't matter if it's private counsel or a public defender, you need professional assistance. The court is thoroughly unconcerned by your budget or your job.
