My question involves a traffic accident in the State of: Texas

My son and his fiancee were recently in an accident in which he was trying to get over in the right hand lane but was cut off before he could completely make the change. Because of this he had to quickly move back in the left lane that he was exiting. He never completely left the lane.

He was entirely back in the left lane about 5 seconds before the car behind him hit his rear end and ran up under his truck.

Our insurance company has denied the other drivers attempt at a claim.

His insurance company is trying to deny my sons claim. They are saying there are extenuating circumstances.

We believe the other driver is claiming that my son switched lanes right in front of him leaving him no time to stop.

As of right now we do not believe there are any injuries...

And here in Dallas police will not even come out to the scene of an accident if there are no injuries so a police report was not filed.

My sons truck is a 1998 Ford Ranger and probably only worth a couple thousand dollars. We believe the damage is right at about that amount but according to the claims adjuster that came out to take a look at the truck the damage is just over one thousand.

The one place that my son took it to have an estimate of damages done got angry and said there was no way his damages could be repaired for so little and that the claims adjuster was just trying to avoid totalling out the truck.

This is my sons very first accident and it is quite upsetting to him. We think the insurance company may be giving him a hard time due to his age...he is only 22.

We sure would appreciate any advice we could get regarding this situation...

I would just have our insurance fix it and go after the other driver but we only have liabilty with un-insured motorist so we are not able to make a claim on our insurance.
