    Default Can You Cancel an Agreement to Sublease Your Apartment

    My question involves landlord-tenant law in the State of: Wisconsin

    I have asked my leasing office to sublet (current lease valid till Feb 2017) my apartment and have signed a document agreeing my leasing office to show my apartment for prospective tenants. Yesterday I got a mail saying that my apartment is subletted but I have not been intimated at all. Now that I want to hold back my apartment, my leasing office is not agreeing to it.

    You asked the leasing office to sublet. Did you give them a time frame? Did the "document" allow them to lease, or just to "show"? What exactly does the document say? I don't know what intimated means.

    If you signed a contract with your landlord indicating that you would vacate at a certain point in time, and that you wanted them to sublease your unit from that point in time forward, then that's what you agreed to have happen -- and given that most landlords have little interest in finding subtenants, your landlord apparently did a very good job carrying out your wishes. They have no obligation to keep notifying you of the status of their search, although obviously you are free to make all the inquiries you choose to make.

    If you wanted to rescind that agreement, the time to do so would have been before the landlord found a subtenant.

    If you try to back out of your contract, you can be liable for damages to your landlord -- so you had best read the document you signed under which you agreed to the subtenancy, or have it reviewed by a lawyer. If you want to share the key language here, you may do so -- but recall, we cannot interpret contract language that we have had no opportunity to read.

    Language from the document I signed for sublet -

    <Leasing office Name>, hereinafter called XYZ grants permission to Sumanth (myself) hereinafter called Lessee, to sublet <Address>, hereinafter called premises.

    Permission to sublet is contingent upon fulfillment of following requirements:

    1. Lessee agrees to advertise the premises for rent and will advice XYZ when the advertisement will be running. Lessee will show the premises to prospective renters whenever possible. Upon receipt of the signed agreement, RSI will list the premises as available to rent and assist Lessee in his/her efforts to sublease. It is understood that unless a prospect specifically inquires about the premises for sublet, XYZ's first responsibility is to rent the property owners' vacant apartments. In no way will XYZ attempt to steer a prospect inquiring about the premises for sublet into different apartment, unless the prospect (1) rejects the premises for sublet as potential home; (2) does not qualify to rent the premises for sublet

    2. Lessee will refer all interested parties to XYZ to complete a rental application and pay in full the earnest money, The earnest money for the premises is $$$. All sublet application are subject to verification and approval by XYZ. XYZ reserves the right to reject any unsatisfactory or incomplete applications pursuant to policies in effect. Once a sublet application is approved, the Sublessess's earnest money deposit will be applied to their security deposit obligation, and the sublet applicat will be required to sign the lease, and to abide by all provisions therein.

    3. Original Lessee is obligated to pay all the rental payments and utility bills when due until such time the sublease commences. Lessee assigns all rights, title and interest in the premises to sublessee. Original Lessee gaurantees performance of all terms and conditions of the lease by Sublessee.

    4. Incentives or concessions offered by Lessee to Sublessee must be handled as follows: Negotiations of incentives will be done directly between Lessee and Sublessee. Lessee will pay the TOTAL amount of any concession to XYZ no later than the day the sublease is signed by Sublessee. Payment will be made by money order or cashier's check.

    5. Sublessee must comply with XYZ rules and guidelines, including pet policies, if applicable.

    6. Lessee agrees to completely vacate the premises, perform a final walk-through inspection of the premies with Landlord's representative and surrender all keys, garage door remotes, etc., on or before noon 2business days prior to the day Sublessee is schedule to take the occupancy. Lessee will advise XYZ in writing immediately upon vacating the premises. Within 21 days of the day Sublessee take occupancy, XYZ will provide a written itemization of any charges to be deducted from security deposit.
