If you want to stay with your husband and help him through this, consider consulting a criminal defense lawyer. Otherwise, consider consulting a divorce lawyer.

Whether I stay with him or divorce him, will our assets such as our house, cars and other personal property be subject to part of an embezzlement lawsuit? In other words, would I or we be subject to losing any of this property due to his embezzlement/forgery if he were, indeed, eventually convicted of such?

These are issues to discuss with your Attorney.

My main reason for posting here is to find out what I should do after finding the checks I mentioned. I don't know what my husband is up to and I don't really know how to go about finding out, so that is really my concern. I understand at some point I need to see an attorney, but my main question is, do I need to do that now if I only suspect him of something illegal, i.e. are the signed, blank checks that belong to the company he works for enough to take to an attorney? As I mentioned, if I were to ask him he is NOT going to tell me the truth and I would blow my cover then I wouldn't be able to do anything. That's why I don't want to confront him first. So does that mean seeking legal council is my only recourse at this point? And if so, what type attorney? I don't know if I will divorce my husband or not at this point because I don't know until I talk to an attorney what all this entails, so that would be a decision I would make after seeking legal council, so what type of attorney do I need to see now?

I could only guess as to what steps his employer might take to recover the money, assuming he were found to have embezzled funds.

You seem to be leaning toward the former.

No, not at all - I'm not leaning toward the former or the latter because right now I don't know whether he is guilty or not. Hence, my reason for first coming to this site - to seek advice about what to do when you have some evidence and it looks suspicious, but you don't really know what is going on. Who do you turn to, what do you do - that's my original question and concern. I can't phatom even thinking about divorce or what I will ultimately do until I know what he is up to, which definitely could be embezzlement or nothing at all. I realize if he is guilty of embezzlement that will surely impact our personal assets and we also have children I have to think of as well, so those are all decisions that would have to be made down the road when I know what is ACTUALLY going on, but how do I find that out? Hence, my problem and question to those who visit this site. Does that make sense?

Try to find a multi-disciplinary practice, with both divorce and criminal defense lawyers on staff, or a lawyer who practices in both areas.
