    Default Changing a Child's Name After Remarriage

    My question involves name change laws in the State of: Maryland

    I want to know how do I go about changing my child last name, my child is 5 years old and have my last name. I will be getting marry in less then 6 months. I am currently pregnant and this child will have their dad last name before I get marry. I want both of my children with the same last name. My 5 year old have no father on their birth cert and I never found out who it was because my fiance now has been in my child life since day one. My 5 year old calls him daddy since day one. I want to know what are the steps to changing my child last name and will it be a problem if I just said that my fiance is the father.

    do you mean; will your son be upset that you lied to him about who his father is?



    so, where is the father currently?

    Of course you can't lie on official documents.

    But with that said, even if Dad (whomever that may be) was around he would have trouble (generally speaking) arguing against a name change, because the child has never had his name to begin with.

    Still, you have to go through court. You may have to do a "john doe" service though.

    It would appear that Mom doesn't actually know who the father is...
    unless she was riding with the Hell's Angels, she likely could narrow it down to a very few guys.

    If I knew where he was then I would tell him. My Fiancé been in his life since day one so it doesn't matter.

    I didn't say I didn't know who he is I said I don't know where he is, but thank you for the ones that did answer my question

    Actually, it does matter regardless whether you think it does or doesn't. The presumed father often must be notified of any action taken involving the child.

    So my question again is, if I don't know where he is, his name is on no documentation and my child last name is mines. How do I go about changing his last name to my soon to be husband.

    Wait...he's not on any documentation? Meaning he is not on the birth certificate? So has not acknowledged paternity?
