They should, yes. But if they don't, her options are limited to small claims court because neither the Feds nor the state of Florida is going to do diddly about it. And it's by no means certain that she'd win in small claims.
Agreed. There are no federal rules on this. And very few states have rules requiring the employer to make such payments absent an explict employer policy. Basically CA and a few other states (not FL). Some states have a "follow your policy" rule. FL however does not have any such rules. If the employer has a formal policy to that effect, then small claims court becomes a possibility. I worked for an employer with employees in 34 states whose policy was to buy out vacation balances upon termination only when required by state law. And this was a very legal policy that was indeed tested in court.
