    Default How Did They Get Anyone to Consent to Be Recorded on to Catch a Predator

    Both parties have to consent to the recording of a conversation in FL and many states. HOW THE HECK did they get ANYONE to appear on this show?!

    You'll notice that during a criminal investigation, the rules are quite, quite different.

    In all but the first couple of shows they had police involvement which means it's possible that they obtained court orders allowing the taping without the consent or knowledge of the suspect.

    It's also possible (I haven't checked) that the first couple of shows (without police participation) were done in one party consent states.

    And some all party consent states have exceptions for recording a crime in progress.

    But I do not understand how they are able to make money of a person's image without that person's consent.

    I thought it went like this:
    I take a photo of you. It's on the street in NYC. You are recognizable. I do not get a release but you're in public with no expectation of privacy. I can use that image as long as I don't make money from it, but, if and when I sell that image--- I need your consent.

    Right? Wrong?

    These guys were in "private" homes. I would think there would be an expectation of privacy?

    They weren't in private homes - they were part of sting operations. And there's no expectation of privacy during the commission of a crime.

    Have you ever watched ID channel?

    Actually, no. I don't have a TV. I'm one of those people.

    The first were all done in one party states. Makes sense now. I didn't realize that one and two party consent also applies to video.

    Video is actually easier to legally record - it's audio that makes the whole thing tricky.

    But again, you seem to be missing a major point here. Well, two. The first is the expectation of privacy - well, ya kinda throw that one out when you're committing a crime.

    The second though, is that once again, the rules for criminal investigations are completely different.

    You do realize there is no such thing as "Reality Tv"? All it is is todays version of Pro wrestling. It is all 100% staged and pre-rehearsed.
