I was arrested in 2001 in Illinois for retail theft and got a six month court supervision. There was no convictiona and at the end of the supervison the case was dismissed. Early this year I got the arrest record sealed. Now I am applying for a medical job in Arkansas and the application form asks about previous arrests or charges. Do I have to answer yes even if the record was sealed? Secondly, the state medical board representative told me that they will not be disclosing it to anyone because the case was dismissed and sealed. So do I speak the truth to the hopital and let them know or hide it since the State applelate website for illinois says that I don't have to disclose the arrest record to an employer? They will be doing a background search as a part of the application. This has not shown up on 2 previous searches but I want to know whether I need to get embaressed by giving them information that I don't really need to or can they still fire me if they find out (after I respond with a no) even though the Illinois state appelate website says that I don't have to tell them.
I have posted this question on another forum too and wanted your opinion as well. Please advise.
