Only if he refuses to respond to the notice you will be required to send him.
In other words, when you petition the court to change the child's name, it will be required the father be given notice and an opportunity to contest or at least address the issue. Only if he refuses to respond to a properly served notice or fails to appear in court once properly served will the judge consider taking action without the fathers input. Even if he doesn't show, you will still be required to justify changing the name.
jk, unfortunately this Mom has made it quite clear elsewhere that she wants Dad out of the picture completely.

You haven't mentioned one single thing to indicate that getting rid of her FATHER is in her best interests.

Excessive drinking, marijuana smoking, terrible language(cussing), and really bad anger management.. Lead to supervised visitation.. which he's had for almost three years and hasn't changed at all in his favor because he never utilities the time he gets to build a relationship with the child, and the child still wont let him hold her. He isn't suppose to drink/smoke 24 hours prior to seeing her, maybe that's why he never showed, I don't know. But I think the bio dad needs to worry about himself more then the child at this point, because the child can benefit from it later if he cleans up his act.
The court has ruled that he's still her father.
Now he's wanting Skype visits and you're against that why?
It's a very reasonable way of allowing the child and Dad to have frequent contact, and there's no way on this planet you could possibly say that such contact would be endangering her - right?
Win/win.
If you keep calling him "bio-dad", you're going to find yourself in a very bad situation. (legally speaking)
