    Default Ex Girlfriend Trying to Kick Me Out of My House and Other Problems

    State of Arizona

    I recently broke up with my girlfriend, and things didn't go so well. I never have touched her or her child, or had any fights in front of her child. Last night we had a fight over text in which my true feelings for her and her child came out, but nothing was abusive. I probably hurt her feelings, but nothing else. Her child is 7 years old. I am a good law abiding citizen, I do a lot of volunteer work, and I work on our County Search and Rescue team.

    She is threatening to kick me out of the house. I am the main person on the lease, she is secondary. I have a scheduled plane ticket to move back to my home state in early September, but I need to be here until then as I have no other place to live. She is threatening to call the cops on me to have me removed. Can she legally do this?

    Another problem I'm having is that I'm very scared of her. I am scared that she will potentially do something like hurt herself, her child, or make false claims to authorities to have me put in jail and ruin my future life. I would like to record video and audio of my living space but she says she does not approve of it. If I am the main lease holder, does that allow me to record anything I'd like as long as their general privacy is kept and I inform them that I am recording?

    As a male, I feel helpless in this situation. Please help!

    Audio - a bit fat "no". Even if you inform Mom, that does not make it ok to record her without consent.

    Video - well, Nannycams are generally ok in every State PROVIDED they don't record audio.

    Mom also has a reasonable expectation of privacy in the bedroom and certainly the bathroom. So don't even think of doing anything there. Taping the child might come with other issues, specially if Mom doesn't agree.

    If she calls the police, and is able to articulate a fear of bodily harm or just a threat, she may be able to obtain at least a temporary restraining order which would effectively make it impossible for you to stay where you are.

    Thanks. Do you have any suggestions on how to protect myself? Leaving is not an option.

    Have you seriously looked into shelters?

    If you're genuinely concerned about being set up - and I'm aware that this does happen - about the only thing off the top of my head is either leaving or having someone present with you every single time you'd otherwise be alone with Mom and her child.

    You say this today but tommorrow you'll want to leave ... have a new lease written replacing you & her with just her. There is no "secondary" leasee .... you both have equal responsibility & rights
