    Default Physical Violence with Other Family Members

    In the state of Pennsylvania-



    A question from a 19 year old PA resident. So if my father gets into one of his ugly moods and I decide not to take his verbal BS and say something and instead of verbally getting whacked, I get whacked physically and in return I return the hit in kind with a smack on him, self-defense as I would like to call it, am I legally in trouble now, is he, or are both of us in deep legal trouble if my brother would call the police on us?

    BOTH parties in a physical altercation can be arrested. The self defense is an issue for a jury to decide. Note that self defense is the LEAST amount of force needed to protect oneself. It's NOT just a "tit for tat".

    To stay out of jail, yep. You walk off, and call the police.

    The relationship doesn't matter. Violence is violence. Take the hit and walk off. And/or call the police.
