    Question Photographing a Neighbor's Front Yard

    My question involves criminal law for the state of: New Jersey

    Let's suppose one is trying to document a case of a nuisance barking dog and one wishes to obtain for the file a photo of the culprit dog barking. Is it illegal to, from the public street (in front of the house), take a picture of the dog in question barking in the front yard of the house where it lives? If so, under what circumstances would this be illegal or would it be illegal in all cases? Are there special circumstances in which it would be legal?

    I've long been curious about this.

    As long as its in full view of the public, like in the front yard, you can take as many pictures as you want.

    Thanks free9man. Out in the open, you say. May I presume that the same would be true of a making a video recording using, say, a camera phone or the like?

    of a dog barking; you are fine. If you record conversations, it is generally legal to record where there is no expectation of privacy but it is much simpler to avoid recording human conversations.
