    If they are legally your children you don't need permission from anyone to move including the dad. If you have an agreement with him stating you are going to stay in that state or give him notice of your move than that is what you need to do. Even if you two are divorced and you have custody of the children the only thing that can be filed is a show cause through your own local magistrate and even then if they are your children naturally no crime is committed.

    And so now Julie... let's talk about all the reasons why you are FLAT OUT WRONG.

    1. Once the case is filed, there is a standard restraining order in place for the person filing that includes NOT TAKING THE CHILDREN OUTSIDE OF THE JURISDICTION OF THE COURT. This becomes valid towards the respondent upon service (maybe you should read up on CA law before you start answering questions)...

    Not to mention... CA doesn't even HAVE magistrates.

    So even if I drop the case, and he hasn't been served, I'm still under a standard restraining order to stay in CA?
