    Default Laws Pertaining to Pregnancy

    I reside in VA,

    My problem is that my son and his girl friend are going to have a baby and the mother of the girl friend will not allow her to communicate with our family in matters pretaining to the pregnancy. We want to make sure she is getting the proper care. My question is can the mother legally keep my son from having this information and should we contact social services and have them investigate to make sure the girl friend is getting the proper car?

    Any sound advice would be great.

    if the girl is a minor, yes. The girls mother can refuse any and all contact with your son or you.

    If the girl is under the age of 18, she is absolutely under the care and control of her parents. If they say she can't communicate with you, that's the end of it.

    You're not entitled to any information about the pregnancy, in any case, and legally, neither is your son. Until the child is born and paternity is legally established, your son is a legal stranger to the child. So are you, and will remain so even after paternity is established.

    Your son would be well advised to pursue DNA testing through the courts after the child is born to legally establish paternity. He'd should then make support arrangements and pursue visitation or even joint legal custody.

    Social services will be reluctant to investigate a case where there isn't actually a child yet; your son's girlfriend doesn't have to share any information whatsoever with your son.

    When the child is born he has the right to establish paternity, custody/visitation and child support; but until then it's up to his girlfriend.

    Out of interest - because this may be an issue - how old are they both?

    That being the case, her parents absolutely can restrict or prohibit all communication with you and your son.

    yep.


    until she turns 18, her parents are her guardians and as such, can take any action the deem appropriate to take care of their daughter. That means if they say she cannot speak to your son, then that is what it is.

    after she is 18, she is free to move out and do what ever she wants.

    Then absolutely - her Mom has the absolute right to control who is communicating with her child, period.

    Okay we do not dispute that she has to right as her mother to restrict her communications with us, We are simply concerned that her mother is not getting her the proper prenatal care that her and the baby deserve. That is the information that we are trying to get from them and my son being the farther of the baby isnt he entitled to make sure that his child or child to be is being cared for?

    There isn't a baby at this point - I'm not saying that to be harsh, but to be accurate.

    Your son isn't the father of anyone yet and thus has no parental rights.
