    Question Statutory Rape in Georgia

    I have read up on Statutory Rape in the state of Ga. from several sites. Just to be sure, if the female was 16 when she became pregnant and the male was 18, then that means that I am charged with a misdemeanor, correct?

    Then, if so, what might I serve?

    and, what about if her mother presses charges...which i dont think she will.

    It's weird, I heard I was OK and could not be touched due to the rules or whatever, and here I am almost three months into her pregnancy and my mom calls me and tells me that DFCS has called her and said that the Sherriff's Dept. was going to pick me up on statutory rape charges when they find me. I'm not hiding, I'm just trying to figure out WTF is happening. So I looked online and found "Statutory Rape: person has intercourse with a person less than 16 years of age, sentence of 1 to 20 years, except where defendant is 21+ years old, sentence is 10-20 years; or where victim is 14 or 15 and defendant is no more than 3 years older than victim shall be misdemeanor.", and other artices saying the same thing in different words... Did this help or need more info?

    P.S. We have a good female friend who just went through the same thing (got pregnant at 16), but her BF was like 24 or something, and she went to court and the court said they could not touch him because she said it was consensual.

    Georgia's statutory rape law provides,
    Quote Quoting Georgia Code, 16-6-3.
    (a) A person commits the offense of statutory rape when he or she engages in sexual intercourse with any person under the age of 16 years and not his or her spouse, provided that no conviction shall be had for this offense on the unsupported testimony of the victim.

    (b) A person convicted of the offense of statutory rape shall be punished by imprisonment for not less than one nor more than 20 years; provided, however, that if the person so convicted is 21 years of age or older, such person shall be punished by imprisonment for not less than ten nor more than 20 years; provided, further, that if the victim is 14 or 15 years of age and the person so convicted is no more than three years older than the victim, such person shall be guilty of a misdemeanor.
    Georgia also has a child molestation law. Beyond that, I have know way of knowing what law you might be charged with violating.

    I do want to thank you for this help and for all the help you and others provide to all of us in need of your knowledge.

    I found this article as well, but I had trouble interpreting it. Either way I am almost certain I am in the clear, but you never know anything these days. Would you mind putting it in a little 'simpler' terms. plz & thnx

    P.S. The 'rumor', I guess we should call it, was that I was charged with Statutory Rape. I'm not saying I couldn't be charged with the other one or both, just saying.

    As I read the statute, the age of consent is sixteen. That doesn't mean the age of "getting her pregnant" - if you had sex before she was sixteen, you are subject to being charged. I don't see the "Romeo and Juliet" provision you describe; if you are aware of another statute, perhaps that's the one the rumors are about.
