    Default Crisis with a 13 Year Old

    My question involves criminal law for the state of: Florida.

    Hi, when I was 15 I fondled a 13 year old which I immediately stopped after i had started because i knew it was wrong.

    The issue is me being labeled as a sexual predator, is this possible ?

    The act was entirely consensual and I've never forced anything upon any woman but her father is telling me that I could go to court.

    She tells me that it was an honest mistake and that she understands what happened wasnt right and I'm really glad that she's ok.

    But could i really go to court ?

    You could.

    You'd have to be charged first, though. Probably with lewd and lascivious behavior.

    I believe so. I have not looked up Floridas guidelines but that would constitute a sex crime and would appropriately be listed.

    Sorry but a 13 year old cannot consent to sex so no, it was not consensual.

    But could i really go to court ?
    Oh ya. without a doubt

    4) LEWD OR LASCIVIOUS BATTERY.--A person who:

    (a) Engages in sexual activity with a person 12 years of age or older but less than 16 years of age; or

    (b) Encourages, forces, or entices any person less than 16 years of age to engage in sadomasochistic abuse, sexual bestiality, prostitution, or any other act involving sexual activity

    commits lewd or lascivious battery, a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
    (5) LEWD OR LASCIVIOUS MOLESTATION.--

    (a) A person who intentionally touches in a lewd or lascivious manner the breasts, genitals, genital area, or buttocks, or the clothing covering them, of a person less than 16 years of age, or forces or entices a person under 16 years of age to so touch the perpetrator, commits lewd or lascivious molestation.
    (6) LEWD OR LASCIVIOUS CONDUCT.--

    (a) A person who:

    1. Intentionally touches a person under 16 years of age in a lewd or lascivious manner; or

    2. Solicits a person under 16 years of age to commit a lewd or lascivious act commits lewd or lascivious conduct.

    (b) An offender 18 years of age or older who commits lewd or lascivious conduct commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

    (c) An offender less than 18 years of age who commits lewd or lascivious conduct commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

    I mean if she doesn't want to press any charges then how would I be able to be taken to court ?

    And would it be juvenile detention, house arrest ?

    It pains me so much to have to ask these things but I cant take any chances

    her desire or lack of desire to press charges is irrelevant. She has no say in the matter. The state is the entity that presses charges. She is merely a witness and a victim.

    If the state decides they want to press charges, that is what will happen regardless of how she feels about it.


    would you go to juvi? I don't know. We are talking felonies here. It is up to the state but I suspect you would start in juvi and then, if the sentence is long enough, be transferred to adult prison when you turn old enough by Florida's rules. Since you did not state how old you are now, you may be old enough to go straight to the big house.

    I would be very surprised if the state would take this anywhere. You are also under the age of 16. Try not to worry about this and just do not have any more contact with her. Her father has made it clear he does not want you around. No girl is worth going to jail for. So man up, and stay away.
