    Default Received Employer's Unemployment Appeals Notice

    My question involves unemployment benefits for the state of: Indiana

    I don’t understand the appeals process.
    I was fired 1-27-09. I filed for Unemployment 1-29-09.
    I received my first Unemployment check on 2-07-09.
    On 2-17-09, I received a Determination Letter of Eligibility stating that “the employer had failed to provide sufficient information to establish the discharge was the result of willful misconduct.”....Conclusion of case=“Claimant was not discharged for just cause”...“Determination will become final on 2-27-09 if not appealed”.
    On 3-07-09, I received a Notice of Filing Appeals stating “U.I. Appeals has received a request for a hearing....Issue: Whether the employer discharged the claimant for just cause.” They will be notifying me of the hearing.
    How long is it before a hearing date is set? A friend of mine went through the same thing a month ago and was told the hearing might not be until NEXT January due to so many increased filings this year.

    I’m still receiving my payments. Am I going to have to pay back all of that?
    I was told that the employer always wins--no matter what!
    I was fired for breaking a new rule that had been in effect for a couple weeks. I did not maliciously break the rule--I had just simply forgotten it that day. It was NOT written policy, it was only verbal plus the new rule was established by my immediate boss--not the Executive Director or the Company.
    Please tell me I have a good chance of winning this!

    None of us here can tell you whether you will win the appeal. It will be up to the "state" to decide after a review of all information. All you can do is tell the truth during the appeal process.

    There is no possible way for us to know what the backlog may be in an unknown office of your state's UI division.

    I have a very similar situation and time line. I received my notice on 3/6/09 and should receive notice of a hearing date next. I also want to know if benefits I receive during the time before the hearing & determination would have to be paid back if the employer's appeal is upheld. Does anyone know??

    If the employer wins the appeal, your benefits will be stopped and you may be asked to repay benefits you already have received.

    Your entitlement to unemployment benefits based on the wages you earned from a particular employer is determined by the reason you separated from that employer. If you are disqualified based on your separation from a particular employer, you may have to repay the benefits you have already received based on that employment.

    Thank you so much, and the same to you! This is so confusing to me! I've never had to go through anything like this before!

    I guess all we can do is wait and see what happens.
