If they really needed the computer for evidence they would NOT be telling you they wanted to see your computer - they would show up with a search warrant. If they don't have anything, they might be fishing. i agree with Aaron, contact an attorney.

Also, if they do serve a search warrant, unless the officer writing it is a complete moron, the warrant will not limit the search solely to chat logs. They will be looking for anything related to such a conversation to include files, e-mails, digital images, file caches, etc.

Yes, good point I'm not sure it's time to plop down 2K on a lawyer though.

When would be a good time? After they cuff him and book him?

That pretty much the standard isn't it? Until charges are filed there isn't much a lawyer can do.
I mean he can do certain things and be more involved in making sure no rights are violated. But having to spend a couple of thousand dollars on what turns out to be a bluff/fishing expedition isn't good husbandry.

I think the suggestion was consulation which many Attorneys offer free intially. OP should not be answering Police questions without an Attorney or at least consulting one

Actually, Kist, an attorney can sometimes prevent the arrest by sorting the matter out ahead of time. Once arrested, it is hard to un-ring that bell in the public eye (and an arrest IS a public record), and if he were arrested for having kiddie porn or inappropriate conduct with a minor, it will be hard to overcome that stigma even if the case is never brought to trial.

I'd rather spend $1,500 to avoid an arrest and trial than cross my fingers and pay two to three times that amount later.

Oh yea, I hadn't thought along those lines. I wonder if there would be any merit in retaining an attorney and moving the PC to his office.

I think Op's first action should be to consult an Attorney and see what advice he/she has

so far the detective hasnt called back. theres no way i could be busted for kiddie porn becuase i know for a fact they didnt send me nude photos, so even if they had every convo logged and read it there would be nothing at all in it referring to naked pics of her. if i do talk to the detective im just going to tell him what u said that i'll cooperate but i would feel better talking to my attorney first. thanks again for the advice people it has helped.

The problem is right or wrong doesn't always matter when dealing with "crimen exceptum." http://news.cnet.com/8301-13578_3-9899151-38.html
