    Question Released From Lease And Asking For Rent Back

    Ok so here is the problem.... My roommate released me from the lease and I moved out 5 days after we paid the rent. I did the calculations and i should have received $179 back for the days that i would not be in the apartment. The guy in the office even said that my roommate could change the locks on the apartment and i could not get back in even if i had paid for a full months rent. The electric bill is in my roommates name and I pay it because he was having trouble paying it on time and our lights would get cut off. The bill for the electric was 128 dollars and i did not pay it as to recoup my money for rent that I had paid and would not be able to live there. My roommate is saying that he is going to take me to court for the unpaid electric bill. I need input on what I should do and if i should have paid the electric bill, and if I was entitled to the $179 of rent that i was not going to be living there, also if he takes me to court will I have to pay for the fees that it would cost for him to do it.

    What state are you in?

    What type of a lease did you have?

    How long was the lease for and when did it start and when was it suppose to end?

    What was the reason you were released from your lease?

    We'll start with those questions.

    I am in GA
    The lease was for a 2 bedroom apartment where both of us were on the lease
    The lease was for a year and it started in Sept. 2007 and ended Sept.2008
    I was released from the lease on Feb 5th because my roomate insisted on bringing people to the apartment that I did not get along with and had to call the police on once before because they were comming and going in and out of my apartment as they pleased when no one was there.

    Did you request to be released from the lease?

    If so, what kind of notice did you give and how long ago did you give it?

    Originally I had told him i was moving out in 30 days then the next day we went to the leasing office to sign the release form and they were like well if you don't have your things out by Sunday then he can legally have the locks changed so I packed up my stuff and left 2 days later which was Saturday.

    I don't know why the leasing company told you that.

    You had paid the rent and had until the end of that rental period.

    All that aside, I can see why you would want to try and recoup money you feel you are entitled to.

    I can also see why the roommate may believe that he does not owe you a refund of rent that you paid. If roommate was willing to let you stay until the thirty days had expired.

    You can play this out and see if roommate takes legal action against you or not. Then you can let the court sort it out for the two of you or you two can come up with an agreement that will settle the matter.
