    Default Is There Any Legal Trouble For A 30 Year Old Dating An 18 Year Old?

    I started dating my boyfriend when I was 17 (who was 29 at the time). I am now 18 and he is 30. We have kept our relationship a secret but my parents have almost found out. We both live in North Carolina, so I know the age of consent is 16. Can my mom press any charges on him (stalking, pedophilia, anything at all)?
    Also, my mom has been emotionally abusive for years now and its just beaten me down and its been hard to live with. I am am the valedictorian of my class and have a full scholarship to a university so my school is covered and I really am a good student who doesn't drink or do drugs. Other's (coaches, teachers, friends) have also recognized her abusiveness towards me and I feel like I have an adequate case of emotional abuse. She also once spanked me when I was younger and gave me bruises and DSS had to come inspect me. Could I get emancipated and live with my boyfriend? How would I do that, would I need a job and would I have to move out first before I got emancipated?

    You are 18 now, so I don't understand why you are asking about emancipation.

    You are legally an adult....

    I don't know what charges your mother believes she can report against him, if you started dating him at the age of 17. (Contributing to the delinquency of a minor....?)

    So I could just move out and my parents could not order me back by law or take out a restraining order or anything on him?

    I don't know what reason your parents are telling you that you are still under their authority. You have legally reached the age of majority.

    § 48A-2. Age of minors.
    A minor is any person who has not reached the age of 18 years.
    If she makes a report with the police, I'm sure they will inform her that you are an adult and they can't do anything about it.

    She tells me I am under her authority to control me and make me believe I am powerless and must put up with her abuse. Thanks for telling me my real rights.

    Sounds like an attempt to try and remain in control of you.

    Keep in mind, that FAFSA will require your parents information if you need to fill it out for financial aid, student loans....

    It sounds like you will have enough for your tuitition fees..., but you may need federal loans for living expenses.

    That is covered, I have a full scholarship including room and board, books, tuition, meal plan and everything, so I haven't had to deal with FAFSA.

    I wish you luck, although it appears you have worked very hard to achieve what you have accomplished and may not need it.

    Keep focused, keep setting goals and keep in mind, you may have several boyfriends before you meet the one you will want to spend the rest of your life with.

    What kind of activites would contributing to the delinquency of a minor include and could he be convicted of anything now that I'm 18? I never took drugs, alcohol or did anything illegal together.

    If an illegal act was done while you were a minor, it doesn't matter that you have turned 18.

    From what you post, that you haven't done anything illegal, this statute wouldn't be something he could be charged with:

    § 14‑316.1. Contributing to delinquency and neglect by parents and others.

    Any person who is at least 16 years old who knowingly or willfully causes, encourages, or aids any juvenile within the jurisdiction of the court to be in a place or condition, or to commit an act whereby the juvenile could be adjudicated delinquent, undisciplined, abused, or neglected as defined by G.S. 7B‑101 and G.S. 7B‑1501 shall be guilty of a Class 1 misdemeanor.

    It is not necessary for the district court exercising juvenile jurisdiction to make an adjudication that any juvenile is delinquent, undisciplined, abused, or neglected in order to prosecute a parent or any person, including an employee of the Department of Juvenile Justice and Delinquency Prevention under this section. An adjudication that a juvenile is delinquent, undisciplined, abused, or neglected shall not preclude a subsequent prosecution of a parent or any other person including an employee of the Department of Juvenile Justice and Delinquency Prevention, who contributes to the delinquent, undisciplined, abused, or neglected condition of any juvenile.
