    Default Florida Name Change For Minor Child

    I recently got married in 2006 and had a second child with my current husband last year. My 6 year old from a pervious relationship wants my husbands last name. I have his last name and her sister does as well. We have not seen or heard from her "biological" dad since my divroce was final in early 2006. He does not pay child support, is not around, and has not been apart of my daughters life since 2005. I am assuming he is still in Florida because I recieved a letter from the IRS recently to tell me his tax return would be garnished for non-payment of support.

    My question is what do I need to do to get my oldest daughters last name changed to be the same as mine, my husbands, and my second childs? Also, how hard is it to prove that the last name change is in the best interest of the child?

    You can petition the court to request a court order allowing the name change. Probably the best thing to do for now is to get a consult with a local attorney. You can get a very low cost 30 minute consult by calling the Florida Bar Lawyer referall service at 1-800-342-8011.

    Thanks alot for your help. Do you know how difficult it would be to get his parental right terminated so that my husband could adopt my daughter. I had some people tell me it could cost almost 10K for the adoption, so we are saving up because we think it is more than worth it.
