    Default Home Ownership and Mortgage After Breakup

    So about a year and a half ago I purchased a house with my girlfriend in Illinois. We have since broken up. Now she wants me to sign it over to her after getting papers from the local court house. If I sign the papers I will no longer co-own the home, but will I still be responsible for the lone?

    I am not sure what’s the best thing to do.

    DO NOT SIGN A QUIT CLAIM until the mortgage has been refinanced or yes you will still be responsible for payments. IF she refi's you would sign at closing...

    Absolutely correct.

    And while you're at it, get some dough from her for signing the deed.

    Thanks for your help, but now I have another question. As I am still out of the country, can she file a suite against me in order to get a judge to sign the quit claim deed?

    Also, does she need to somehow serve me with the papers she files or can she do this without my knowledge?

    A: It is a suit, not a suite. She can sue you if you are on Mars or sitting right next to her. It's called a partition suit.

    A: You have to be served. Some states allow service by publication which means that the notice of the lawsuit is published in the local newspaper.
