    Default What to Do if Your Car Catches on Fire

    My question involves a consumer law issue in the State of: CA

    I lent my leased car to a friend. The car is about 7 months into it's lease at the time. Iwas out of town. Car catches fire in the middle of a street. Contacted insurance and gave friends info to provide witness statements. Friend cannot be reached and had disconnected the number after the incident. I have the fire affidavit and photos sent to me. I have comprehensive coverage.

    Is this a lemon case?

    Nothing you have stated suggests the lemon law applies in any way.

    So less than a year into it's lease and the car catches on fire isn't grounds for a lemon case?

    That would depend on WHY the car caught on fire, wouldn't it?

    Something smells fishy in CA.... Until you know the cause of the fire, how do you know who is to blame? Were the police/firefighters called? Have they given you or your insurance company any report on the cause of the fire?

    Got the fire affidavit from the fire Dept. The insurance is lagging though. Opened the case in Oct. I even already had the recorded statement twice. I have another one coming up. And all I'm thinking is what other questions are there? And whats the hold up. They have the evidence. The only thing they don't have is the driver's testimony. I can't get a hold of that person either.

    What did the fire department say regarding the fire?

    I'm wondering if the insurance company is investigating this from a potential arson standpoint. You lent it to a mysterious friend who then drops off the face of the earth after borrowing your car when it caught on fire? It's gonna raise some eyebrows.

    Exactly.

    It's treated as a suspicious claim and the insured gets put through the wringer until the claims people are satisfied that the insured is not complicit.

    Same thing can happen with cars that are "stolen and then wrecked" by someone the owner knows.....
