    Default Co-Signer Wants to Get Removed of the Lease

    My question involves landlord-tenant law in the State of: Ga
    I am trying to get removed out of the lease because of certain issues and wanted to see if I could get removed as the guarantor and if that does happen, what does it mean for the other tenants in the home.

    What do you mean "trying"? Who have you talked to? What did you say? What did they say?

    Whether you get removed from the lease depends on what the landlord and your co-signers say about it.

    The landlord isn't going to care what your problems are or who pays as long as he gets 100% of his rent on time every months.

    Your co-signers aren't going to want to increase their shares of the rent by letting you loose without getting a qualified replacement for you.

    And even if that happens the landlord can still hold you responsible until the lease expires and everybody leaves.

    Again, what do you mean by "trying"?

    If you are a guarantor and not a tenant, whether you will be released is totally up to the landlord. If a guarantor was required for the lease, I wouldn’t expect the landlord to be willing to release you from the lease obligation.

    Please take note that if the landlord were to discharge you from your guarantee it would be operation of law release all persons equally obligated under the lease that stand in disagreement to the discharge.
