    Exclamation Getting Married Moving in with Spouse

    My question involves landlord-tenant law in the State of: Washington

    My daughter is engaged. She's is concerned she could be denied being added to her new spouses lease. If she does not qualify at the apartments where her fiance currently lives. Can they deny her being added as an occupant, if they are legally married? They are saving up to buy a new home as soon as they can. So really don't want to use their savings for getting into a new apartment, and having to sign a new lease. So that if they find a house to buy, they should be stuck in a longer lease.

    Why is this such an issue for her? It would be odd for an apartment complex to deny residency/occupancy to a new spouse of a current tenant.

    There is nothing in the WA Residential Landlord Tenant Statute that specifically addresses that concern.

    So, in the abstract, there is nothing prohibiting the landlord from denying an additional occupant.

    Though I can't imagine any landlord objecting unless your daughter has abominable credit or a criminal record.

    It's going to come down to what her new spouse's lease says about tenant occupancy. She should read it. And he should be up front with the LL about her moving in, in case time is needed for other decisions to be made.
