    Thanks, TM. Thats a very important point and hence, I will dig deeper:

    In 2000, the law was unchanged from what it was as of 1998. That statute (IC 4-2-12-4) includes in the list of offenders, "(2) a person convicted in Indiana after June 30, 1998, of: (B) criminal confinement (IC 35-42-3-3), if the victim is less than eighteen (18) years of age;"

    However, the good news is that the duration changed. In IC 5-2-12-13, "Except as provided in subsection (b), an offender's duty to register expires ten (10) years after the date the offender is released from prison or other facility operated by the department of corrections, placed on parole, or placed on probation, whichever occurs last." The subsection (b) stuff says that sexually violent preditors have an indefinite registration requirement, reviewable by the court. However the definition of sexually violent preditor (an individual who suffers from a mental abnormaility or personality disorder that makes the individual likely to repeatedly engage in any of the offenses...") sounds like it likely doesn't apply here.

    So, yes you had the requirement to register in 2009/2010, but the good news is that you're coming up on the ten year limit.

    The bad news, is you should have registered and failure to do so is a class D felony. Those have a statute of limitations of five years, so you won't be out of the woods on that for another six years or so.


    Sorry for the delay and any mistakes in typing the statutes. In order to go back to 1999 and 2000 (which is just a supplement published to the code) and the base 1998 code, I had to resort to Taxing Matters's beloved legal books rather than my West-Thompson search engine (which only goes back to 2008).
