    Default Can You Change Your Child's Last Name to Your Boyfriend's Name

    My question involves adoption law for the State of: New York

    When I was only 4 weeks pregnant my daughter father left me and he even left the country But before he left he abusive me till I almost lost the baby cause he didn't want the baby. When my daughter was 1 year old I started a new relationship since that day May 14 2015 He Been her father in every way. He goes to the hospital with her , school activities birthdays. He is tbe one buying clothes , shoes and food. She is 4 years now her real dad haven't even seen her. He Sells drugs in PR... The last thing I knew about hem is that they are going to send hem to jail or give hem probation because they already Catch Hem Twice Selling drugs. *My Daughter Have My Two Last Names* He Didn't Even Was Her when she was bron.

    My question is how me and my boyfriend can legally put my daughter his last name ?

    He can if you get married and he does a stepparent adoption.

    Should we infer that you expect the child's father to object?

    The court must consider the child's best interest. A court would be hard pressed to find a reason why your child's surname should be changed to that of an unrelated person, and to a surname you don't even share.

    If/when you and your boyfriend break up. You would probably want to have your daughters name changed to your new boyfriends name. I do not see any Judge agreeing to a name change as long as the man is only a boyfriend.
