    Default What to Do About an Excessive Restitution Demand

    My question involves an injury that occurred in the state of: Illinois
    About three months ago I had a little too much to drink and ended up sitting on the sidewalk feeling like heck. Unfortunately a cop drove by and saw me and instead of letting me walk down to my friends house to sleep it off, he called an ambulance because I told him I just wanted to die - what I meant was I felt so rotten I just wanted to die. The ambulance showed up and I was insisting I did not want to go to the hospital. I was forced into the ambulance by the cops and EMTs and taken to the hospital, put in a room and put on suicide watch. You can't make this stuff up. My mother showed up and told them I am not suicidal, just an idiot who rarely drinks who made the mistake of too many drinks. I went home. The cops said they weren't going to charge me with anything. Bad experience but learned my lesson.

    Next thing I know I'm getting an ordinance violation from the police from a woman EMT who is charging me with wantonly and purposely bending her finger back while they were forcing me into the ambulance. I was flailing and trying to get out of the vehicle so they had to tie me down. I didn't even remember a woman being there.

    I retained a lawyer but I don't know if she's new or what. The prosecutor wants a grand for this woman's pain and suffering but refuses to show any proof of injury like doctor bills. My lawyer says there was no video either. Has anyone had this type of craziness happen to them?

    You can talk to your lawyer about the restitution demand and your options. If you do not agree with the prosecutor's number, but want to enter into a plea bargain or are convicted of the charge, talk to your lawyer about whether you should ask the court to hold a hearing on the issue of restitution.

    Have you been convicted?

    If not, it seems like legalized extortion.

    You can insist on going to trial and hope that, without evidence, you get acquitted.
