    Default Will You Receive Jail Time for a First Offense, Classs B Misdemeanor in Texas

    My question involves criminal law for the state of: A class B misdemeanor
    This was my first and last time and I was caught stealing 52 dollars worth of material. I don't know what to do and I am worried that I may receive jail time. I was kept in the store for 2 hours, waiting for HPD and they never arrived. So I did not receive a ticket, but was told to call the next day. I called and they didn't have my case in the system. So I was told that I will more than likely have to wait 7-10 business days. I cannot afford an attorney and will ask for one in court, Is here any possibility that my case could be dismissed? Should I plead not guilty? I have no idea whats going to happen and how long this process will take. I have learned my lesson and not even the thought of shoplifting will pass my mind. Any help would be greatly appreciated.

    The state is one of the 50 US states, not the classification of your crime. Please tell us what state you are in. You've not indicated you have any chance of an outright dismissal.
    Asking for a lawyer at your appearance is a good idea.

    As for other specifics, you need to give us the state name.

    Always plead not guilty. Your lawyer if you get one will tell you that.

    Possibilities are endless but it's hard to know what will happen in getting it dismissed or not.

    I hear they hang people for larceny in Texas, especially for a "fist" offense.

    I missed it in the subject line.

    A class B misd. is good for 180 days in jail and/or $2,000 in fines. You can also expect the merchant is going to send you a civil demand independent of your criminal charges. Those last $2 got you a trip to a real court.

    If I can intuit Houston for the HPD, then you're in Harris County. Harris County does offer a pretrial diversion. It would be a good thing for you and do not screw it up.

    I hope you are not the Jennifer Appletree that already has shoplifting and prostitution priors there.

    If you can get diversion that results in dismissal, that's a good plan. Another is to try to get the charge reduced to a Class C misdemeanor with a deferred disposition and, upon successfully completing the deferral, petition for expungment. Then, don't do it again.
