    Thank you for taking the time to reply and help. A couple of follow-up questions:

    1. Would "I don't want my child to be the only person in her family with a different last name and be the odd one out" be considered a reason in the child's best interest? (she's 5, if that's relevant)
    2. Would this be overseen by the Friend of the Court Referee who signed the custody order or would this be a matter for the Probate Judge?
    3. Anything else you feel might be helpful as you become more familiar with this situation?

    This isn't the 1960's. Families and schools have lots of kids who don't share the same surname.

    FOC has absolutely nothing to do with name change issues.

    I like this solution. This is definitely the best course of action.
