    If he attempts to resolve it by saying he's just going to work 40 hours a week this still wouldn't help get unemployment as the employer is allowed to fire him for not working their arbitrary amount...

    Yeah so he would not get unemployment then as he currently is considered exempt by his employer meaning they are allowed to ask him to work overtime and not pay him more.

    They can request you work...
