    Re: Moonlighting Issue

Agreed. What "craft" or position you hold is not a protected category under the law, meaning that it's quite legal to treat them differently.

Disabilities and Accommodation: Re: Wages Not Being Paid According to Contract

Whether the wage increase is contractually required to be retroactive to the first of the month depends on the exact wording of the agreement, and I mean the entire agreement, not just a sentence or...
  3. Deprivation of Civil Rights: Re: Facebook Violates the U.S. Constitution and Violates Freedom of Speech, Helping t

    Tell you what, then.

Hire an attorney and sue them. God forbid that any public entity be allowed to shape public opinion. Who cares about the First Amendment, anyway.

  5. Re: Kings Coach As Eg. Misguided. Need More Direction

The only people who know exactly what happened are the two people involved. It's not for you to decide what happened. In the absence of proof one way or the other, the only safe action for you to...
  6. Deprivation of Civil Rights: Re: Facebook Violates the U.S. Constitution and Violates Freedom of Speech, Helping t

The above post is the first one in which you asked a question, so anything prior to that was simply ranting. Which is not the purpose of the board.

Nowhere in the Constitution does the law put...
  7. Deprivation of Civil Rights: Re: Facebook Violates the U.S. Constitution and Violates Freedom of Speech, Helping t

The purpose of this form is to provide general legal information, not to support illogical rants that have no legal purpose behind them.
  8. Deprivation of Civil Rights: Re: Facebook Violates the U.S. Constitution and Violates Freedom of Speech, Helping t

Okay, you've made us aware of your thoughts. Thank you for sharing.

If you think a crime has been committed or a protected right vioated, hire an attorney - a message board can do nothing to help...
  9. Slander: Re: Quote-Mining Social Media and a Serious Breach of Trust

Fine. Post the criminal statute that was violated. Or the one that required forum PM's to be kept confidential.
  10. Slander: Re: Quote-Mining Social Media and a Serious Breach of Trust

Different forums can have different rules, but there is no legal requirement to keep the contents of PM's confidential.
  11. Slander: Re: Quote-Mining Social Media and a Serious Breach of Trust

Where did you get the idea that PM's are legally required to be kept confidential?
  12. Slander: Re: Quote-Mining Social Media and a Serious Breach of Trust

What this all boils down to is, you want the right to speak as you please, but you don't want other people to have the same right.
  13. Slander: Re: Quote-Mining Social Media and a Serious Breach of Trust

You may be done, but that doesn't mean everyone else is. When you post on an open forum, you don't get to control who answers or when.

    Or even how...

Not al insurance has the same policy about preexisting conditions.

    Re: How Valid

Is it just me, or have we wandered fairly far from the original poster's question?

    It's just me?

    Okay, then.

    Carry on.

    ^^^^^This.
  20. Re: Being Set-Up to Fail- Should I Stay (Let Them Fire Me ) or Just Quit

Ask the attorney about both potential ADA and FMLA violations. I think FMLA is the stronger claim but I can't rule out ADA from what you've posted either.
  21. Re: Being Set-Up to Fail- Should I Stay (Let Them Fire Me ) or Just Quit

Then I'd say you should be talking to an employment attorney at this point regarding your best options.
  22. Re: Being Set-Up to Fail- Should I Stay (Let Them Fire Me ) or Just Quit

At any time, did you inform your supervisor or HR that you needed flexible work hours because of a medical condition? I don't mean in response to a question, telling them that you have x condition; I...

What in your working conditions would need to change for you to accomplish all the essential functions of your position? I do not mean, for the supervisor to get off my back. I...
  24. Re: Former Employee is Claiming She Was Injured, but Was Already Cleared by a Physici

Keep in mind that some injuries, particularly soft tissue injuries, can legitimately take a couple of days to manifest. That's why it's so important to let the experts handle this.
  25. Police Conduct: Re: Do I Have to Sit on the Ground when Told by an Officer

"Often" means that by far most people that stand in front of an officer and speak to them are not being legally detained.

You got a cite for that? Or is that your opinion?
