Re: Is Driving a Privilege or a Right

You already posted all that. Once a Judge asks you if your toyota Camry is a motor vehicle or not, and you respond that it is not, you loose all credibility in your legal pursuit.

Re: Is Driving a Privilege or a Right

Edward do you know what Judicial Notice is?

Judge: Officer was he driving a motor vehicle?

Officer: Yes, he was driving a Toyota Camry!

Edward: Objection, there is no proof that a camry is a...

    Not a chance!

    18 USC 242

You have a legal opposite to ALL who post here on the forum. I should have known better to waste my valuable time with you trying to help.

Re: Is Driving a Privilege or a Right

Once again, an abstract useless citation. Read this Syllabus from a just decided case, on what the word/phrase meant then, as opposed to what it should mean now, and what it does mean now.

Re: Is Driving a Privilege or a Right

You do not need to read any book to know that, proving once again you know little about the law. It's already part of TN law as with other states and Statutory Construction elements. Figured you know...

Re: Is Driving a Privilege or a Right

Really, I never knew that. The answer/ruling to the "Question presented" is all that matters. There can be 50 internal citations, that does not abrogate the the decision. They are meant as guidance...

Re: Is Driving a Privilege or a Right

Edward, your problem is, you are citing a million cases and trying to piece them together until the jigsaw is arranged to your satisfaction. You cite this case from MO, in 1870. First, as has been...

Re: Is Driving a Privilege or a Right

Prouse's ruling was no law enforcement officer may seize (stop) a motor vehicle for the "sole purpose" of determing if the driver has a license. Mirroring your WA AG opinion.

Re: Is Driving a Privilege or a Right

I told myself I would not reply to any more threads like this, as no amount of legal reasoning will convince the poster they are wrong. Maybe mine will.

The AG opinion you cite is from Washington...
