    Re: Help

I really apologize Bud, my error, I don't know how I missed that. I wish you would have corrected me earlier, the old noggin is not as sharp as it was in my handsome youth. :D

    Re: Help

I understand that completely TM, but since the topic was about Dereliction of duty, the tort claims act has Zero bearing and probably confused the poster is all I was getting at, nothing against Bud.

    Re: Help

Your own link refers to actions under Chapter 85, this is 85:

    Re: Help

Then since you brought up Defamation as a tort, you do not have to file a tort claims notice to file such suit, it does NOT apply. Read your own link of what actions the TCA applies to.

    Re: Help

Bud, the Tort claims mechanism is not applicable to the type of lawsuit he is referring to, Dereliction of duty.

What you link is similar to Ohio's Political subdivision tort liability act.

  6. Re: the George Floyd Situation, Et Al. I Have an Idea on How to Help, but Have No I

Riff, simply because it is an arrestable offense does not mean that an arrest is mandatory, not talking about felonies now.

To TM, damn you're good. :encouragement:
  8. Counterfeiting: Re: Is It Legal to Print Fake Pretend Play Money if We Change a Lot of Features

I know that, but the way you phrased it:

If we use the "as follows" construction, PL then DF in the same sentence may be taken as, "I have sued"--- "I have been sued". I should have deciphered...
  9. Counterfeiting: Re: Is It Legal to Print Fake Pretend Play Money if We Change a Lot of Features

If so, his statement, at least to me, is misleading, as it followed a question of being sued!
  10. Counterfeiting: Re: Is It Legal to Print Fake Pretend Play Money if We Change a Lot of Features

How were you a defendant when you were not sued?
  11. Counterfeiting: Re: Is It Legal to Print Fake Pretend Play Money if We Change a Lot of Features

You can also assume it is REAL, what is seen that is, and the rest, hidden, is phony.

Crook displays a suitcase with 2 million dollars in it. What is seen on top is real hundreds, legal, right?

Criminal Investigations: Re: Can Police Search My Vehicle

That confirms what I stated. Gant was already in the police car where he had no access to the passenger compartment and the police searched after he was secured. The OP was at the passenger...

Criminal Investigations: Re: Can Police Search My Vehicle

He was within "reaching distance" of the passenger compartment when arrested though, one prong of par. VI at my post 17.

Assuming arguendo it was indeed a valid "search incident to arrest", NO...

Criminal Investigations: Re: Can Police Search My Vehicle

The crime charged here is not relevant. The relevant point is where he was standing when arrested, and Gant controls I would think.

Criminal Investigations: Re: Can Police Search My Vehicle

A careful reading of Gant, one of the most recent vehicle search cases, it appears to me the search was legal. Where you were standing you were without question a "Recent occupant" of the vehicle....

    Pleadings: Re: Pleadings vs. Motion

Karl, it seems the clerk is acting outside her/his legal authority. If the filing is improperly titled/captioned, that is up to the court to address, not the clerk's. If not accepted as titled, ask...

    Re: Law is Not Determinative

The stooges were posing as cooks and were acting stupid in the kitchen.

    Butler:

Such levity, you remind me of the Three Stooges.

    Curly:

    Hey, that's an insult.

Deprivation of Civil Rights: Re: Wrongfully Arrested, Violation of 4th Amendment

Police enjoy QI which has to be overcome in a 1983 action, but it happens all the time. But the Tort claims act has no bearing on a 1983 action so I won't address those particulars.

Deprivation of Civil Rights: Re: Wrongfully Arrested, Violation of 4th Amendment

Yes but this is a "False Arrest" claim. If defacto right, 1983 might only allow a nominal award IF facts justify it, however a government entity can not flip it's nose at a false arrest case due to...
