Re: Is Driving a Privilege or a Right

Yeah, no. You're showing your ignorance or complete misunderstanding of whatever 100 year old case you read again.

Re: Is Driving a Privilege or a Right

The officer is not required to be a legal expert. Nor does there have to be any "damage" for 99% of traffic offenses.

You do not have the magic bullet. You do not have the gotcha moment to set...

Re: Is Driving a Privilege or a Right

Traffic offenses are normally strict liability offenses that do not require a showing of intent.

Re: Is Driving a Privilege or a Right

You have been told your defense is garbage yet you continue to tilt at the windmill. You are not listening and are not going to listen. Also officers are not required to know all that stuff so that...

Re: Is Driving a Privilege or a Right

Guys, he's not going to listen. He doesn't want to listen. Let the judge throw him in jail for a few days for contempt when he starts spouting this garbage and doesn't shut up when told to.

Deprivation of Civil Rights: Re: Excessive Bail-Lawsuit

Traffic judges are not clerks. You are misreading something.

As I pointed out earlier, the ruling regarding license suspensions for fines was overturned in May.

Deprivation of Civil Rights: Re: Excessive Bail-Lawsuit

That's nice but it doesn't change the fact that at the time of the arrest, the officer was able to convince a judge you were resisting. Therefore, the arrest and bail are not out of line at that...

Deprivation of Civil Rights: Re: Excessive Bail-Lawsuit

Please provide a statute, besides the one which references clerks, that backs up that assertion regarding the bail amount. I don't see one anywhere. Further, there are exceptions to the requirement...

Deprivation of Civil Rights: Re: Excessive Bail-Lawsuit

Could you please stop changing your story/adding undisclosed facts to it when someone shows you are wrong. The judge is not REQUIRED to change the bail if they do not feel it is excessive. Further,...

Re: Is Driving a Privilege or a Right

What you need to understand is that these, and similar/identical, arguments have been used over and over in courts across the nation. They fail. Why would you think that you, a layperson, has...

Deprivation of Civil Rights: Re: Excessive Bail-Lawsuit

You would believe wrong. It specifically says the clerk when the judge isn't available. I'm guessing there is something else going on that made the judge set your bail so high but there's no way for...

Ok. What does that have to do with any of the responses you have received?

Deprivation of Civil Rights: Re: Excessive Bail-Lawsuit

The only reference I see to a $1000 limit is if the bail is set by a clerk. Since you reference suing a judge, it would appear a clerk didn't set your bail so the limit doesn't apply.
  14. Re: Sales Tax on Smart Phones More Than Local Tax?

Oddly enough, that would give an even larger amount of tax than they were charged. If you were to use the NYC sales tax in the OP plus the federal tax, it would work out to right around $110 though.
  15. Speeding Tickets: Re: Can You Be Pulled Over for Going 1 Mile Over

As long as we're making up crap to apply to OP's boyfriend's situation, maybe he hasn't gotten his license yet because he is missing some form of paperwork. Maybe he can't afford it. Maybe he's...
  16. Re: the George Floyd Situation, Et Al. I Have an Idea on How to Help, but Have No I

Ah yes, let's equate fighting for freedom from tyrannical rule with property damage. Makes perfect sense.
  17. Re: the George Floyd Situation, Et Al. I Have an Idea on How to Help, but Have No I

Are you implying I might be happy? Nah. Sad? Yeah, probably.

So? That is their choice. Still doesn't justify shooting someone. Period. Full stop.
  18. Re: the George Floyd Situation, Et Al. I Have an Idea on How to Help, but Have No I

Nope, I wouldn't. Things can be replaced. That is what insurance is for. I'd be mad, no doubt. If I could get my hands on the person doing it, I'd get physical but I would never shoot someone...
  19. Re: the George Floyd Situation, Et Al. I Have an Idea on How to Help, but Have No I

That thinking right there is part of the problem. Property crime, be it destroying or stealing it, is NEVER an acceptable reason to shoot someone. Should they be arrested? Absolutely. Law & order...

Layoffs and Reductions in Force: Re: What Are My Right Can I Sue the Emploter

What state did this occur in? If you are in the US, there is a chance that your job makes you exempt from OT so you would not be due any additional pay for the extra hours worked. We would need to...
  21. Retail Fraud / Shoplifting: Re: Forgot to Pay for a Plant at Lowes, Walked Out from Exit While on Phone

Depends on the store. Possibly really good or possibly really bad.
  22. Retail Fraud / Shoplifting: Re: Forgot to Pay for a Plant at Lowes, Walked Out from Exit While on Phone

If they were to do something, which based on the current state of Lowe's LP system I highly doubt and my 10+ years in LP, it would be a chicken$%^! move by the LP person. Could it happen? Sure but...
  23. Retail Fraud / Shoplifting: Re: Forgot to Pay for a Plant at Lowes, Walked Out from Exit While on Phone

Go back, explain you noticed the plant wasn't paid for when you checked your receipt. Oh wait, you don't have a receipt. Offer to pay. They will just take your money and maybe thank you for your...
  24. Re: the George Floyd Situation, Et Al. I Have an Idea on How to Help, but Have No I

  25. Background Checks: Re: Medical Cannabis Card Affects Security Clearance

Do not lie on the security clearance application. It is at best a surefire way to get fired at the least.
