    My question involves criminal law for the state of: Louisiana

    I was recently caught shoplifting and charged with misdemeanor theft. My lawyer has gotten me a diversion but to enroll in the program, I would need to take a hair test. However, I have smoked marijuana in the past few months and would most certainly test positive. I'm sure I would have to enroll in a drug intervention program as well as the diversion program that I am already supposed to sign up for. I was wondering if there is any way to avoid taking the hair test? Do I have to give up the diversion program in order to avoid it? Can I ask my lawyer to expunge the misdemeanor charge?

    If you prefer to have a conviction, tell your lawyer you're unable to stay clean for the term of the diversion and that you prefer to simply be convicted of the crime.
