First MIP in Michigan, 18, Open Container
My question involves criminal law for the state of: Michigan
Me and two of my friends were driving back home from Standish and we noticed a cop driving really close from behind so we pulled into the gas station out of nervousness and so did they. The cops asked us a few questions and asked the driver to come out of the car.
They searched the car and found a empty beer can also, just for detail.
The driver passed all the sobriety tests, but he blew a .055 and they took him in the cop car. He didn't get arrested, he didn't even get a driving ticket, though it states he was the driver on the MIP ticket. This is his third MIP, his first one is off his record but he recently got an MIP in Florida about a month ago ontop of this one, I was wondering what may happen to him? He 19 years of age and will plead guilty.
My other friend who was in the passenger seat blew a .155, this is his fourth MIP, he's on very strict probation right now. I was also wondering how long he would be going to jail for and generally what may happen? He is 20 years old and will also plead guilty.
As for me, I blew a .075. This is my first MIP, I'm 18, I plan on pleading guilty also. But last year I got caught shoplifting, got put on HYTA (?) probation for 6 months and they drug tested me twice a month. I got off two months early for good behavior and getting all my classes done and testing clean, even though it took me about two months to get clean for THC. Would my shoplifting record be brought up in court or increase my chances of being back on probation? I just wanna estimate how much this may all be in case I do have to drug test again. I'm guessing I'd also have to take some sort of class? From what people said, the fine is around 100 dollars, correct?

The consequences of an MIP can vary dramatically based upon the attitudes of the local judges and prosecutors. You and your friends should consult a local criminal defense lawyer.
in terms of your HYTA, by "I got off two months early" do you mean that your case was closed and you were discharged from probation? If so, the new charge is not going to violate your HYTA probation. If this was in the same county, the prosecutor and probation department will be aware of the prior.
