Child Support Catastrophe
My question involves child support in the State of: California:wallbang:
Good evening everyone...this is my first post and I hope to have more to share as well as possible offering advice on what I already know thus far. For now, I am hoping that someone can share or counsil regarding what is going on with my current situation...
I'll make it simple and to the point without long egated details....
Here goes..
My kids live 2 states away...
I have the right to see them 2 weekends each month...
I see them twice a year for 177 hours total.
She is re-married and has another child.
They both have a quality income together.
I am single making 16 an hr.
My back child arrears are 1,000 total.
She gets all my tax refund money.
She gets 1,050 a month which is 525.00 a paycheck every two weeks.
Basically...when it's all said and done...I don't mind taking care of my kids.
What I mind is that I am not living right. My car got repossesed....I can barely pay rent and I live paycheck to paycheck having to borrow money from my friends all the time...After taxes and child support, I make 12,000 a year which is below poverty level and for the work I do which is back breaking, I am to the point where I am about to give up all together.
I have requested a modification...They reviewed it and denied it by letter. I explained my hardships and they don't care. 50 percent automatically through CA state law which is from our lovely govenor that put this in effect.
Like I said, I don't mind putting food on the table...but when I cannot even eat myself....not able to buy groceries for 4 years now for myself....something has got to give...I just want my percentage to be lowered and need to know the best way to go about doing this.
Thank you and I apologize for my sob story...it's absolutely fantastic to get it out in the open and makes me feel a bit better.

Be happy it's only 50%, in some states it's 55 - 60% of your income when you're in arrears.
You have not not been able to buy groceries or eat for 4 years. You'd be dead by now and unable to make this post.
Your modification was PROBABLY denied because among other things, if your children are living 2 states away, it's likely your support obligation would go UP, rather than down, since you are unable to keep your 2 weekends a month and that results in a lower timeshare, which makes your support go UP.
CSSD probably did you a favor.
