    How Can My Fiancée Get Emancipated in Florida
    My question involves emancipation laws for the State of: Florida

    I am 18 and my fiance is 16 (about to be 17). She lives in a home that is not physically abusive, but is emotionally abusive in many ways, such as her parents treat her horribly, yell at her for literally nothing, accuse her of nonsense, do not trust her for no reason, etc etc. Also, while her parents have never physically abused her, they have threatened it numerous times. Neither of her parents have a job or have unemployment or disability, and live off of her grandparents on her mother's side. They live in a 3 bedroom trailer with her father, her pregnant mother (due in May), and her 5 little brothers. They rarely have food and the living conditions outside of her bedroom are disgusting and that of near squalor. Her mother refuses to bring her to the doctor or give her medicine when she's sick, but will help herself any time. While her grandmother would gladly do any of these things for her, her mother does not allow the grandmother. As I've stated, there is rarely food in the house (especially with 6 children, including herself), but her mother will regularly cook food for only herself and not allow any of the children to eat any. Both parents are unreasonably overprotective and do not allow her any freedom or friends (male or female). She is constantly in fear of her safety due to her father's history of abusiveness with his past wife, not to mention the daily harsh emotional abuse from both parents (being called a whore, being sworn at, told by father that he is "glad that she will burn in hell" , etc). She would have a job (technically she has a summer job at school, making ~$120 per week) and vehicle, but her parents do not allow it. Her mother does not have her license, and will not allow her to even get her learner's permit. If she were not living with her parents, a job and vehicle would be attained quickly.

    To give some background on her, she is a very good person. She has never been in trouble with the law or at school. She has perfect attendance and always has good grades (A's and B's). She always follows the rules, does not smoke, does not drink, does no drugs. She has a completely clean record. Any adult, such as teachers or relatives, would gladly attest to all this and tell that she is mature beyond her years. She plans to go to college and has many plans for the future, unlike her parents.

    About me, I am enlisted in the Army National Guard, have a steady income, have a vehicle, have a high school diploma, will be going to college soon. Not to mention, my parents would also be very supportive. I have no doubt that I would fully be able to support her and I without a problem. I am currently living with my parents, but will be moving into an apartment or small house early next year.

    My question is: would there be any possible way to get her emancipated or at LEAST put into the custody of her grandmother and grandfather? If Child Services were called, they would easily see that the living conditions in her household are not suitable for her, or her siblings. Would Child Services put her in the custody of her grandparents or close relatives, or would they put her in the custody of a foster family that she does not know? Thank you.

    who cares? If it is as bad as you state, somebody needs to be contacting CPS so ALL the kids are taken care of. There is a possibility that the children will stay right where they are but if CPS deems things need to change, they will require mom and dad to change things.

    It is really impossible to say just what they would do. They try to not break up families if the situation is fixable.

    What if she were to become pregnant? Her parents are not able to support themselves, her, or her siblings, much less a baby of her own. That would also be bringing a 7th child into a small, dirty, 3 bedroom trailer. If she were to become pregnant, would that change things and make it more likely for her to be taken out of the household?

    I'm not talking about her being emancipated, I mean would she be put in the custody of a relative?

    In Florida the parent/guardian must initiate the petition anyway.

    She could possibly go to a relative, but they'll want that relative to be FAR from the person who impregnated her, or, she could go into foster care, or, she could be sent to a group home for pregnant teens where she'll get more oversight than she ever thought possible.

    And just for the record, I was not planning on getting her pregnant for the purpose of getting her out of there. There is a possibility she may be, but I'm sure she's not. We both just wanted to know.

    Or, since she would be unable to care for HER child, since she would also be unemployed (or severely underemployed), uneducated and practically homeless, they could take this non existant child and put it in foster care...

    right along with your little girlfriend.

    If she's being abused and neglected as bad as you say she is... why haven't you called the authorities so that ALL of the children are properly cared for? Or is it just your little friend you are concerned about?

    No, I don't. That's not nearly the attitude of an adult. The whole reason why DCFS was created is so that people can report when children are being abused or neglected. Reporting abuse and neglect is EVERYONE'S responsibility.

    Oh... and are you admitting to having sexual contact with a child?
