    No Longer in Possession of I-94
    I am an US citizen who married an illigal immigrant from Mexico. His parents brought him here seven years ago when he was a boy (He's 20 now.) with a B1 visa and an I-94. When his I-94 was about to expire his mother sent it back to her sister in Mexico so that she could turn it in for him. His B1 Visa is still valid untill 2012, but he no longer has an I-94.

    We are trying to adjust his status and have filled out the I-130 and the I-485, but we have left the I-94 slots blank because he no longer has one. Is there a way for him to get a new I-94 without returning to his country and setting the ten year bar? I wasn't sure if he qualified for the I-102 because his I-94 was not lost, stolen, or destroyed, but it was returned.

    Any help would be greatly appriciated! :confused:

    Why not file form I-102?
