How Can I Find Out My Daughter's Legal Last Name
    OREGON

My wife gave birth to her while we were going through a divorce and she had an RO against me. She would not allow me to be there when my daughter was born. How can I find out what my daughter's legal last name is? When my wife gave birth to her, my wife had my last name. Is it possible for her to still have given my daughter her maiden name as her last name? My daughter is 5 now and if possible I would like to petition the court to change it if in fact she does not have my last name.

In five years, you've never bothered to get a custody or parenting time order for your own daughter?

Is that an answer? Are you saying that her name on the court docs/parenting plan are/is her legal name? I once got docs from child support that had her last name as mine, later that changed, so I'm at a loss. Again I'm not sure if you're really asking a question or if that question is an answer...

two divorces in 5 years and they both filed RO's against you?

I hope you plan on being single from here on out. With this history, I would suggest it might be a good plan.

anyway, do you know where your ex and daughter are? are you currently required to pay CS for this child?

    Is that an answer?

No, quite obviously it was a question. Not even a difficult one. Why didn't you answer it?

    OK...just a question:

Are you truly interested in your kid? Or just your kid having your last name?

Now...think about what confusion this will cause a child....I've been raised as Tina Smith, now I'm Tina Johnson....

Does anyone know the answer to my question? I'm trying to stay on topic. I'm not sure what my foolish choices in women and the other comments and questions have to do with answering my question.

If answering the questionnaire put to me by some responses will get me my answer I have no problem doing that, but no one has even qualified their questions by stating such.

Don't see why I'm being demanded, scolded even, as it were- to answer questions by people who aren't answering mine.

I care deeply about my daughter. I have fought for her bitterly in court and have parenting time and I do pay CS.

Why didn't you answer mine then? I was hoping it was a rhetorical question, and that it simply went over my head, giving you more credit than to simply ask me more questions. Furthermore when did I say I didn't have parenting time with my daughter? I never said either way nor was my question about parenting time. Does me asking this question constitute a lack of parenting time order? If your question has nothing to do with answering mine I don't see why you asked it.

TWO? When did I say two?

well, there is this current one where you did get divorced and then in your other thread:

    Quote:

So I go to the court to find out what the ETA is on the divorce proceedings. Come to find out there ARE *no* divorce papers filed. I wait two more days, still no divorce papers. So I call to make the report of the items as stolen or missing. [My step daughter advised me that my things very well may have been pawned, and when I contacted the pawn store they said I would need a police report to get any items back, if they even had any]. I tell them everything and the cop I talk to can't give me a straight answer. He calls my wife, then calls me and says that she is about two seconds away from getting a stalking order against me. I'm like WHAT?! I have had NO COMMUNICATION with her WHAT SO EVER since I got what I could when the officers were there!!! Apparently my wife got him all excited to defend her by lying to him. The officer tells me some contradictory information and I throw it in his face, probably ended up making him feel very foolish. He then ends up coming to my current address and arrests me with the charge of initiating a false report. He said he had probable cause because I admitted that another officer had already spoken to me about it two days before saying that it was a civil matter. But I told him that in fact it was not because that officer thought there was a divorce pending and there in fact is NONE. She even told the cops that they were trying to serve me with divorce papers and I was refusing them. Not so, there currently is no divorce filed by myself or my wife at this time.

Did the police violate my civil rights?

Were they covering for their friend cop who is dating my wife?

I get the RO dismissed and come home to this cop living in my home, with my wife and MY THINGS and *I* am the one who goes to jail.. is this right?
the inference in the other thread is that it is a current situation. If it is the same situation as this one involves, you need to get over the other situation as it happened 5 years ago and little things like the statutes of limitations come in to play plus you apparently didn't feel it enough of a grievance at the time to do anything about it.

If these are different situations, there would have to be 2 wives, 2 RO's, etc.
and in your other thread, again, you infer there is an ongoing situation where nodoby has filed for divorce yet:

    Quote:

    04-12-2010, 08:24 PM

Not so, there currently is no divorce filed by myself or my wife at this time.
So, which is it? Two different situations or simply a bunch of lies?

One presumes that if you actually spend time with the child, not only will her legal last name be on the visitation order, but if you ASK the child, she'll TELL you.
