Terminated for Propaganda - Sexual Discrimination/Retaliation
My question involves labor and employment law for the state of: Kansas
Approx. 2 weeks ago I had a doctors appointment and my suporvisor ridiculed me for it taking 3hrs and said some hateful things. I reported this to his suporvisor.
Last week, I was to suspend an employee, but she had quit instead.She called my suporvisor/hr dept. stating that I was a drug dealer, was sleeping & living with the asst. manager. The acusations were investigated and I was asked if I we were in a homosexual relationship. My asst. & I do live together, the company relocated us to work for them. He was to become the new GM of the other location in town. We've been revamping stores for 5yrs now and have a knack at doing this, the company pursued us.
The company denied ever knowing that we lived together, evan though they signed & paid for our moving exspenses/lease etc. Our addresses are the same in HR & payroll for almost 1 year. They wanted to transfer my asstant due to the living situation and any other issues that may arise for the legal aspect of it. Which I can understand. I discussed this situation with the director of operations, and he as well denied knowing anything, although he's the one that approved our lease.
The manager at that location come to ask me why he was xfering, and I told him it was because we lived together. (He already knew this) Then he asked why we were ever allowed to work together since we lived together. I told him it was because our old suporvisor wanted to terminate him and make my asst. the new GM of his store...(again he knew this because of the past suporvisor being terminated for sexual harrassment against me, but maybe he didn't).
The next day I was called into a meeting and was told that I was terminated for "propagada" because of what I told the other GM.
I have done an oustanding job with this unit and have never been written up with this company. I do not discuss my sexual preferance with anyone (the old suporvisor assumed & made accusations, then made degrading comments, and I made a complaint so people in the company found out),this was 3month ago. I work within the fast food industry.
I have never heard of being terminated for this and don't understand it. I feel as if I was retaliated against and/or terminated for my sexual preferance. From what I have researched on propaganda,it involves politics and war. Any help or comments would be greatly appriciated. Thank You

There is no legal definition of "propaganda" as relating to employment law.
Unfortunately, sexual preference is not a protected characteristic under either Federal or Kansas law. It is protected in some states, and it is not impossible that it will eventually be protected under Federal law, but right now, in Kansas it is legal to terminate on the basis of sexual preference.
Discuss the situation with an employment attorney but right off the top, based on what is in your post, I'm not seeing any clear illegality.

cbg: Thank you for the response! Yes I have spoken with an attorney today. The company policy states that they don't discriminate against sexual preferance, race, religion,etc. He is checking with a colleague to see if that would tie them into the EEOC laws. Yes, I know there are no laws on sexual preferance-sad to say.

Company policy is not law.

Federal law prohibits discrimination based on race and religion, for example. As you have been advised, neither federal or Kansas law prohibits discrimination based on sexual preference.

For what it is worth, any retailer I know of would have a problem with the manager and assistant manager of the same location living together ESPECIALLY if they are in a relationship.
I notice you left that out.

I completely agree! Except for two things-the company fully knew of our living arrangements(they moved us,etc) & we're not in a relationship. I could completely understand it if we we're! But we're not! I don't believe I left it out "was sleeping & living with the asst manager"-2nd line of the thread.
Not trying to argue, I just needed some advice! I appriciate the comments. Thank you

I really wasn't trying to make this an issue of my sexuality, I never made it an issue at work, it was an issue that the company had with it "hurting" their image. My sexuality is my business & not others, I like to keep it that way, hence the ananymous name.
I honestly and sincerlly do appericiate all the feedback, it has helped me make some needed decisions. Thank you

No, you said you were accused and did live together. I cannot tell from a post in a forum whether or not "living together" meant a relationship or not.
