Re: Running from Security
It doesn't matter if the store got it back or not. The crime was committed whether a recovery was made or not. If the store finds out who he is you can be certain he will be charged with at least shoplifting. Maybe more since he ran and fought.
Re: Running from Security
It is also perfectly legal for the security person to detain him.

Do you think they would wasted their time on a charge when the security person was forceful and my friend didnt do anything physical... also if they did press charges would he be arrested or just sent to court
Re: Running from Security
It's not a waste of their time. It what they get paid to do so they have a lot of time to work on it. It doesn't matter if the security person was forceful. Your friend resisted by running so he had every right to use the least amount of force necessary to detain.
Re: Running from Security
Do you think he should call or go back and try to work it out with them? The security guy hurt him pretty bad when he grabbed him so he is kind of scared and his arm is in pretty bad shape... He just wants to work it out with them would pay whatever they demanded and stay out of their store
Re: Running from Security
I would almost bet money that store has already filed charges because you friend decided to run (and hurt his arm in the process).
The store will most assuredly file charges in order to document the confrontation should your “buddy” come back and try to sue.
It’s all about the liability!:D
Re: Running from Security
Do you really think a judge is going to believe that your friend was hurt by the security guards after coming clean a few days later?
The guards will say I don't know what he is talking about and your friend will still be charged with shoplifting and related charges to fleeing.
You asked if he will be arrested, Yes he will be. He may not spend anytime in jail but he will get his day in court to explain.
Re: Running from Security
why would he get arrested if they got their money, got their stuff and it was only a 30 dollar difference? hes not going to sue anyone and he didnt try to fight the guy, he just took off... from what i read there is no charge for fleeing anyone but a cop...
how would he know if they filed charges?
Re: Running from Security
LP will file charges to protect there asses... They don't know if your friend will file charges or not so they may as well hit him first.
This is how the game is played, and the ball is now in LP's court.
In some states fleeing from LP is chargeable as robbery or larceny. Also getting into a scuffle could add a charge of battery. You may want to look up your state statute.
Re: Running from Security
"only a 30 dollar difference"
Would it be "only a $30 difference" if your paycheck was shorted that much one week?

Yep, that's pretty much how the game is played. :D
Re: Running from Security
PandorasBox made a great comment. If the amount was "only $30," then why didn't your friend just pay the full amount? Apparently to him, it wasn't "only $30," it was worth more than that that he was willing to risk it all. So, the "only $30" argument doesn't fly here!
Just my 2 cents.
